Transfer a Breach

If you were not the driver or person responsible for the vehicle when the breach notice was issued, you can transfer liability to the person who was. To start, search for your breach notice and select “Transfer Liability”.

Transferring a breach notice is done by completing a statutory declaration that nominates the person who was the owner of, responsible for, or in possession of the vehicle at the time of the breach. Once we receive a valid declaration, liability moves to the nominated person.

What you'll need

Have these ready before you start…

Your details (the person declaring)

  • Your full name, full address and occupation.
  • Your email address, so we can confirm the transfer with you.

The nominated person's details

The person who was the owner of, responsible for, or in possession of the vehicle at the time of the breach.

  • Their full name and full postal address (street, city, postcode and country).
  • Their email address (required), plus phone number and date of birth if you have them.

A signature and any supporting documents

  • You'll sign the declaration on-screen before submitting.
  • You can attach supporting documents if they help (optional). Accepted formats: JPG, PNG, PDF, DOC, DOCX, up to 10MB in total.

This is a statutory declaration

By submitting a transfer you solemnly and sincerely declare that you were not the driver or person responsible for the vehicle at the time, and that the person nominated was responsible. The declaration is made under the Oaths and Declarations Act 1957.

Please make sure the information is true and correct. Under Section 44 of the Land Transport Act 1998, a person is liable on conviction to a penalty of $10,000 for making any statement in a statutory declaration knowing that statement to be false or misleading in any material particular.

How to transfer a breach notice

  1. Search for your breach notice on the Pay a Breach page.
  2. Open the breach notice and select “Transfer Liability”.
  3. Complete the statutory declaration, sign it, and submit.
